  1. GENERAL CONDITIONS OF SALE (GTC) 

VERY IMPORTANT NOTE
On this page are the general conditions of service of the restaurant Chez Madeline which apply to any order of food products to be delivered or taken away (hereinafter an "Order") placed by a consumer customer on the website  www.restaurantchezmadeleine.com

We thank you for reading the general conditions of sale before placing an Order on the Website. By ordering on the Website, You expressly and unreservedly accept that the restaurant is governed by any contractual relationship, to the exclusion of your possible general purchasing conditions.


At any time and without notice, we reserve the right to modify these T & Cs, those applicable being those in force on the day the Order is placed by the Customer. 
These T & Cs will apply to any modification and to any new version of the Website, regardless of the mode of access (this including in particular any mobile website, mobile application, affiliate website or attached site, mirror or duplicate site. which could be developed).

1.     INTRODUCTION / OUR ROLE

1.1     SASCBL is a simplified joint stock company, with a share capital of 15,000 Euros, registered in the Arras Trade and Companies Register under number 850  834  860 RCS Arras whose head office is located at 28 rue de Beaumont 62950 in Noyelles-Godault.

2.1     Legal capacity, age: To place an Order on the Website, You must have: 
-     the capacity for enjoyment and exercise to contract with the restaurant;
-     18 years old.
2.2   You acknowledge and agree that if you have a specific food allergy or intolerance, you will contact the restaurant directly or go to the restaurant's website to verify that  the dish  and the products you want to order are right for you, before placing your order directly with them.

2.3 Orders for alcoholic beverages:
In accordance with article L.3342-1 of the Public Health Code, the sale of alcoholic beverages to minors is prohibited.
It is reminded that alcohol abuse is dangerous for health and that alcohol should be consumed in moderation. By the sole fact of placing an Order on the Website, You expressly waive the benefit of article 1587 of the Civil Code, which provides that the conclusion of the sale of alcohol only becomes final after tasting and the buyer's approval. .
Any Order placed on behalf of a minor, or in his name, and including one or more alcoholic drinks will be refused if We are aware of it. You are responsible for complying with the applicable provisions in this area and, if applicable, their violation engages your responsibility. In addition, proof of identity will be requested upon delivery and / or provision of the Alcohol-based Products.

3.     TO ORDER 
3.1   Placing an Order: Ordering via the Website involves following the following steps: 

-     Before each ordering or after validating your basket, You must enter your personal details  : name, first name, telephone number, e-mail address and by entering your e-mail address. You will then receive an e-mail to the e-mail address indicated to indicate the confirmation of your order, as well as an SMS of the number of the order on your telephone number.


-     You choose the products corresponding to you from the website. You wish to order as well as their quantity, you choose the times and click on "Order"; "  

-     The customer will then have to exchange his personal details protected by our site which are registered in our confidentiality policy below; 

-     The basket recapitulates the selected Products as well as their quantity, the time of the order at which it is possible to collect the order at the restaurant and the total amount of the Order. You can, if You wish, modify the quantities; 

-     Then select the method of payment, check the box "I have read and I accept the general conditions" and click on "Validate and Pay" 

-     You proceed to payment.

When the payment center has given its consent, We will confirm to You, by email or SMS, the acceptance of your Order and the conclusion of the contract with the Restaurant. This email includes a summary of the Order, as well as these T & Cs. We recommend that You keep the email and the T & Cs on paper or electronically. 
3.2   Modify or cancel an order: Pursuant to article L.221-28 4 ° of the Consumer Code, the Products subject to the Order, being perishable goods, You do not have a right of withdrawal. No exchange or return will be made by the restaurant. You therefore do not have the possibility of canceling the Order after it has been confirmed by the Restaurant. 
You cannot rectify the Order either after it has been confirmed by the Restaurant: You can nevertheless contact the restaurant without delay to obtain its agreement on a cancellation or modification of the Order placed before it is processed. However, it is reminded that this is not an obligation of result for the restaurant Chez Madeleine.
3.3   Payment authorization: The Order is only final after authorization from the payment center and receipt by the Customer of the email informing him of the acceptance of his Order. No delivery of the Products will take place without payment.

3.4   Acceptance of the Order by the Restaurant: As soon as your Order is validated on the Website, it will be sent to the Restaurant. Note that any Order confirmation message from Us, or any payment confirmation confirms that the contract for the supply of the Products is concluded with the Restaurant. Our policy is to obtain fulfillment of the Order by the Restaurant as soon as possible and We will inform You as quickly as possible of the status of the Order. However, please note that this information depends on the Restaurant. We can refuse an Order, for exceptional reasons (Order processing time, too late Order time, absence of raw materials or if you order alcohol without justifying that you are of legal age, ...) . In the event that the Restaurant does not fulfill the Order, You will be reimbursed for the sums paid as soon as possible and the Restaurant will be considered to be in violation of the contract which binds you to it. Any payment under this Order will be refunded in accordance with article 4.6.

3.5   Delivery time: We use all reasonable means to guarantee the delivery or availability of the Order within the time period indicated during the Order confirmation.

4.     PRICE, TERMS OF PAYMENT
4.1     VAT, administrative and delivery costs: Product Prices are those indicated on the Website and expressed in Euros. These prices include the VAT in force on the day of the Order. The cost of delivery and all administrative costs or related to payment fees that will be charged to You appear in the shopping cart.

4.2     Price Error: The Website contains a large number of Products for a small number, it is therefore possible that errors slip into the menus and their description. If the actual price is lower than the price displayed on the Website, and We ascertain it, We will apply the lower price to you. If the actual price is higher than the displayed price, and that We notice it, We will inform You of it to obtain your agreement on the supplement. In the absence of agreement on the new price, We will cancel the Order.
4.3     Means of payment: the authorized means of payment are payment or credit cards, PayPal payment, cash payment or payment by check or restaurant ticket during take-out sales.

4.5     Promotional or reduction coupons: Such reduction coupons or the use of promotion codes recognized by the Website may allow you to benefit from reductions on Orders.

4.6     Paypal: Due to current banking practices, at the time of online payment by PayPal, your bank may isolate from your funds available in your account the sum corresponding to the payment to be made. In the event of cancellation of your Order for whatever reason, this sum will be available again in your bank account following deadlines which vary but in principle from 3 to 5 working days and which depend on the bank. Whatever this delay, the restaurant is not responsible for the damage suffered as a result of this withdrawal from the Customer's bank account in the event of cancellation of the Order.

4.7     We reserve the right to refuse any Order for legitimate reasons and in particular in the event of a dispute with the Customer on the payment of a previous Order, of fraudulent payment or attempted payment or of an abnormal request from the Customer.

We  let us indicate  this information on our dedicated web page. When this information contains information  related to  allergies or other information about these foods, we do our best to post these on our website exactly as they do  appear  on the Restaurant menu. If you, or the person for whom you are ordering are sensitive to food allergies, intolerances or if you have other dietary questions (either for yourself or for a person for whom you are ordering), we advise you to contact us directly to check if the chosen product is suitable for you and presents no problem to be able to place your order directly with us.
